AIZAWL Feb 25: The Mara Autonomous District Council(MADC) in southern Mizoram could be facing elections in the near future because of a High and Supreme Court ruling which upheld that nominated members cannot have votes in a no-confidence move.
The Supreme Court had recently upheld the Gauhati High Courts ruling where a nominated member’s appeal that nominated members have the same right as elected members to cast their votes in a no-confidence motion was turned down. The Supreme Court, after it was appealed to by the dissatisfied member, also rejected the appeal saying there was no reason for the SC to interfere in the case.
As a result of this, the notification given by the administrator of autonomous district councils, who is the state Governor, that a vote of confidence is held would have to take place in the near future.
The MADC had been a problematic one ever since the present batch of incumbents was voted to power in April 2005. While the MNF party had claimed 10 seats in the 22-seat council, 7 seats went to the Congress, 4 seats to the Mara Democratic Front and one seat to an independent.
Forming a united legislature party with the independent representative N. Viakhu and the four MDF representatives, Viakhu was made chief executive member and the ULP ruled the roost for a few months.
In November 2005, Viakhu suddenly switched allegiance and went over to the MNF which lost no time in getting their choice of nominated members along with whose strength they formed the government. The Congress was incensed at this saying both sides had only 11 members and that MNF’s move in forming the council with the help of nominated members was illegal.
The Congress’ complaints, however, were brushed aside by the then Governor of Mizoram A.R. Kohli, who is openly known to be on the side of the MNF, and the MADC, under the MNF, continued to operate until the present Governor, Lt. Gen. M.M. Lakhera was installed by the UPA government in mid 2006 which the Congress quickly took advantage of.
Lakhera, after careful study of the situation, finally gave a verdict on November 28, 2006 that a show of hands is made without the presence of nominated members. This was what prompted the nominated member Manase to approach the Gauhati High Court.
If a show of strength is to come, the MNF party will not be able to prove its majority in the council without the help of the nominated members of whom there are four because with its own 10 seats and the one seat from the independent, it would have the exact number of representatives as the Congress and the MDF, which have allied and have seven and four representatives each.
Thus, if the political situation in the legislature parties in the MDC remain unchanged, a fresh election will be inevitable because no party has even a simple majority.
